These Terms and Conditions ("Terms") govern your access to and use of the Reclaim website, mobile application, and related services (collectively, the "Services"). By creating an account, downloading, accessing, or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Services.

2) Eligibility and Accounts

You must be at least 13 years old (or older where required by local law) to use the Services.

By using the Services, you represent that:

  • You meet applicable age requirements;
  • Information you provide is accurate and current;
  • You will keep your credentials confidential.

You are responsible for activity under your account and must notify us promptly of suspected unauthorized access.

We may suspend or terminate accounts that violate these Terms, applicable law, or platform rules.

3) License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the Reclaim app for your personal, non-commercial use on devices you own or control, as permitted by the applicable app store's usage rules.

You may not:

  • Copy, modify, distribute, sell, lease, or sublicense the app;
  • Reverse engineer, decompile, or disassemble the app except where prohibited by law;
  • Use the Services in any unlawful or unauthorized manner.

4) Permitted Use and Restrictions

Reclaim provides wellness and self-support tools for personal use only.

You agree not to:

  • Interfere with service operation, security, or other users;
  • Use the Services for abusive, harmful, deceptive, or unlawful activity;
  • Attempt unauthorized access to systems or data.

5) Medical and Crisis Disclaimer

Reclaim is not a medical device, emergency service, or substitute for professional medical, mental health, legal, or crisis care.

If you are in danger or experiencing a crisis, call local emergency services immediately or contact a crisis hotline in your region.

6) Subscriptions, Billing, Cancellation, and Refunds

Some features may require a paid subscription or purchase. Purchases made through Apple App Store or Google Play are processed by those platforms, not Breakline LLC.

  • Pricing, trial eligibility, and billing cycle details are shown before purchase.
  • Auto-renewing subscriptions renew unless canceled at least 24 hours before the renewal date (or as otherwise stated by the platform).
  • You can manage or cancel subscriptions in your Apple App Store or Google Play account settings.
  • Refund requests for in-app purchases must be directed to the platform where purchased.

7) Account Deletion

You may request deletion of your account in-app through the account settings.

When deletion is completed:

  • Your account and associated app data are permanently deleted or anonymized, subject to legal retention requirements.
  • Deletion is irreversible.
  • Active store subscriptions are not automatically canceled; you must cancel those through your Apple/Google subscription settings.

9) Intellectual Property

All Reclaim branding, design, software, text, graphics, and related materials are owned by or licensed to Breakline LLC and are protected by intellectual property laws.

Except for the limited license granted in these Terms, no rights are granted to you.

10) Third-Party Platforms and Services

Your use of Reclaim may involve third-party services (including Apple App Store and Google Play), which are governed by those third parties' terms and policies.

Breakline LLC is responsible for providing support for the app as described in these Terms. Apple and Google are not responsible for app maintenance or support services.

11) Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

12) Limitation of Liability

To the maximum extent permitted by law, Breakline LLC and its affiliates, officers, employees, contractors, and licensors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or business interruption, arising from or related to your use of the Services.

Where liability cannot be excluded, it is limited to the minimum amount permitted by law.

13) Indemnification

You agree to indemnify and hold harmless Breakline LLC and its affiliates, officers, employees, contractors, and licensors from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Services, violation of these Terms, or violation of law or third-party rights.

14) Termination

You may stop using the Services at any time.

We may suspend or terminate your access if you violate these Terms, abuse the Services, create legal/security risk, or where required by law.

Sections that by nature should survive termination (including intellectual property, disclaimers, liability limitations, indemnity, governing law, and dispute terms) will survive.

15) Changes to These Terms

We may update these Terms from time to time. Updated Terms are effective when posted on this page unless otherwise required by law.

Your continued use of the Services after updates take effect constitutes acceptance of the revised Terms.

16) Governing Law

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles, except where consumer protection laws require otherwise.

17) Dispute Resolution

Before filing a legal claim, you agree to contact us at support@myreclaimjourney.com and attempt informal resolution.

If a dispute is not resolved informally, it will be resolved in the state or federal courts located in Utah, and you consent to that venue, unless applicable law provides otherwise.

18) Apple-Specific Additional Terms

If you obtained the app through Apple App Store, the following applies:

  • These Terms are between you and Breakline LLC, not Apple.
  • The license granted is limited to use on Apple-branded products you own or control, as permitted by Apple's Usage Rules.
  • Apple has no obligation to provide maintenance or support services for the app.
  • In the event of app failure to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • Apple is not responsible for addressing claims relating to the app or your possession/use of the app, including product liability, legal/regulatory compliance, and consumer protection claims.
  • If a third party claims the app infringes intellectual property rights, Breakline LLC (not Apple) is responsible for investigation, defense, settlement, and discharge of such claims to the extent required by these Terms.
  • You represent that you are not located in a U.S.-embargoed country or on any U.S. government list of prohibited or restricted parties.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary.

19) Google Play-Specific Additional Terms

If you obtained the app through Google Play, you acknowledge that:

  • These Terms are between you and Breakline LLC, not Google.
  • Your use of the app must comply with applicable Google Play terms, policies, and payment rules.
  • Google is not responsible for app support or maintenance obligations.
